This suit was instituted in the circuit court of Jackson county, by the plaintiff against the defendants, to recover the sum of $10,000 placed by the latter in the hands of J. E. Campbell, as earnest money, for the proposed purchase, by the plaintiff from defendant company, of certain oil and g’as lands, including buildings and improvements thereon, situated in the Indian Territory, now the State of Oklahoma.
