—In an action to recover damages for personal injuries, etc., the defendants third-party plaintiffs appeal from so much of an order of the Supreme Court, Kings County (Hutcherson, J.), dated December 1, 1997, as denied (1) their motion for summary judgment dismissing the complaint and any cross claims and counterclaims insofar as asserted against *501them, and (2) their cross motion for summary judgment on their third-party complaint.
Ordered that the order is reversed insofar as appealed from, on the law, with one bill of costs, the motion is granted, the cross motion is denied as academic, and…
