This appeal from the clearly correct opinion of the District of Columbia Court of Appeals1 was improvidently granted, in my view, and the case should not be in this court. But, as it is here, it seems to me that Judge McGowan makes a sensible suggestion as to its disposition. I join him in concurring in the result reached by Judge Bazelon, but not in the" latter’s opinion.. The opinion follows:
