¶ 1. In this review of a court of appeals decision that reversed *432and remanded to the circuit court1 to dismiss plaintiffs' claims for breach of fiduciary duty based on a statute of limitations defense, we are asked to determine whether a claim for breach of fiduciary duty of loyalty must be intentional, or whether it can also be based on negligence.
