This is an appeal on questions of law from a judgment entered upon a verdict for the defendant, returned by direction of the court at the conclusion of the evidence. Subsequent to the trial, the defendant died and the action was revived in the name of his administrator as defendant.

Plaintiff brought the action to recover for injuries sustained as a result of a collision, and alleged in his petition, in substance, that as he was crossing East Monroe street at its intersection with Perry street in the city of Sandusky, the automobile of defendant, proceeding in an easterly direction, struck the…
