This matter is now before the court on the parties’ cross motions for partial summary judgment. Defendant moves for partial summary judgment on counts I, V and VI of plaintiffs’ complaint. Plaintiffs did not respond to defendant’s motion; instead, a few days after defendant filed its motion for partial summary judgment, plaintiffs submitted their own motion for partial summary judgment on counts III, IV, V and VI.
