MONCUR, J., pro tem.

This is an appeal from a judgment after a verdict by a jury, and after denial of a motion for a new trial, against the defendants and appellants and in favor of the plaintiff and respondent, and is for personal injuries to the respondent alleged to have been sustained in a collision between two automobiles. The collision occurred on Christmas Eve of 1938 shortly before 6 o’clock when it was dark. Appellant Ernest Peters was the driver of one car, a 1936 Lincoln Zephyr automobile. Appellant, Mrs. Leuenberger, was the owner of the automobile and was riding in the back seat.…
