Tbe plaintiff brought tbis action to recover damages for malicious prosecution, or tbe wrongful abuse of process, as be states in bis brief. Whatever may be tbe cause of action, whether tbe one or tbe other of those named, we think tbe court properly sustained tbe demurrer. Tbe defendant brought suit on a note given by plaintiff, and merely caused a summons to be served on him as be was passing through the State of New Jersey on a train.
