Appellee by bis next friend brought this action in tbe trial court to recover damages for personal *663injuries and obtained a judgment in Ms favor. The action of the trial court in overruling appellant’s motion for a new trial is the only error upon which appellant relies for a reversal.

The facts disclosed by the record show that appellee at the date of Ms injury was a child of about eight years of age and that he was struck and injured by one of appellant’s cars at the intersection of Twenty-second Street and College Avenue in the city of Indianapolis.
