Appeal by Raphael Krasnow from a decree of the Surrogate’s Court of the county of Kings, entered in said Surrogate’s Court on the 7th day of April, 1908.

Burr, J.:

This appeal is taken from a judgment of the Surrogate’s Court of Kings county directing a sale of the real property of which Adele M. Downing died seized to pay the debts of the decedent. Exception was taken to the denial of a motion to dismiss the proceedings upon the ground that the petition did not state facts sufficient to authorize such sale, and exception was also taken to the admission of certain evidence tending to establish that John T. Pirie and Susan Wright were creditors of the decedent, and to the sufficiency of such evidence. These exceptions seem to us to be fatal. The…
