Before the court is the defendant’s motion to dismiss the plaintiffs claims (docket entry 4). For the' reasons stated below, the motion is granted.
I. BACKGROUND

This case arises from a pending mortgage foreclosure. In March 2003, the plaintiff Enacia J. Lewis (“Lewis”) obtained a mortgage loan of $200,000.00 from World Savings Bank, FSB (‘World Savings”).
