MEMORANDUM
WISEMAN, Chief Judge.
This is an action to recover on a bond issued by defendant The Aetna Casualty & Surety Company (Aetna) to ensure the faithful performance of defendant Irwin A. Deutseher 1 as trustee of the estate in bankruptcy of H & S Transportation Company, Inc. (H & S). On September 4, 1981, H & S commenced a voluntary case in the Bankruptcy Court for the Middle District of Tennessee under Chapter 11 of the Bankruptcy Code, 11 U.S.C. §§ 1101-1174.
