Tbe evidence offered by tbe plaintiff tended to sbow tbe facts to be as follows :

On 30 December, 1926, plaintiff, who resides at or near Jonesboro, N. C., deposited with the Banking, loan and Trust Company of Jonesboro, a draft for the sum of $4,000, payable to her order, and drawn on the Continental Fire Insurance Company of New York City. This draft was received by plaintiff in payment of loss sustained by ber by the burning of a house which was insured by a policy issued by said Fire Insurance Company.
