On August 23, 2004, plaintiff Maryanne Phillips (plaintiff or “Phillips”) filed the instant action in the Colleton County Court of Common Pleas “on behalf of herself and all others similarly situated” (the “Class”) against defendants Whirlpool Corporation (“Whirlpool”) and Sears and Roebuck and Co.
