Plaintiff Imperial News Co., Inc. (“Imperial”) initially brought a breach of contract action in state court against common carrier P-I-E Nationwide, Inc. (“P-I-E”). Defendant P-I-E removed the action to this Court as a claim based on the Carmack Amendment to the Interstate Commerce Act, 49 U.S.C. § 11707, which provides for liability of a common carrier under a bill of lading. Imperial seeks damages caused by P-I-E’s failure to deliver goods pursuant to a bill of lading contract entered into between the parties. P-I-E moves for summary judgment…
