Plaintiffs pro se Richard Akbar Salahuddin and Larry Gurley, bring this action pursuant to 42 U.S.C. §§ 1981, 1983, and 1985(3)(1982) seeking a declaratory judgment, damages, and injunctive relief. Defendants, the State of New York, the Governor of New York, the Department of Correctional Services (“DOCS”), the Commissioner of the DOCS, past and present Superintendents of the Greenhaven Correctional Facility (“Greenhaven”), and several employees of Greenhaven, move to dismiss plaintiffs’ complaint pursuant to Fed.R.
