¶ 1. We review a decision of the court of appeals1 affirming an *232order of the circuit court2 granting summary judgment to defendant Town Bank. This case is a priority battle between defendants Heartland Wisconsin Corp. and Town Bank for proceeds of a debtor's legal malpractice claim that plaintiff Attorney's Title Guaranty Fund, Inc. held in escrow pending resolution of their dispute.
