The complaint in this action charges that the appellant, on the 28th day of January, 1870, falsely, maliciously, and without probable cause, filed his written affidavit with and before one Thomas W. Bennett, Esq., who was then mayor of the city of Richmond, in said county, deposing and charging in said affidavit that the plaintiff and one Phoebe Longfellow had been and were guilty of the crime of forgery, in unlawfully, feloniously, and falsely forging and counterfeiting a certain written instrument, with the intent then and there to defraud one William W.
