Defendant appeals from an order denying his motion to vacate the judgment committing him to the Mendocino State Hospital.
Defendant was charged in May, 1950, with assault with a deadly weapon. He was represented by the public defender and pleaded not guilty and not guilty by reason of insanity. Two psychiatrists were appointed by the court to examine the defendant and report as to his mental condition.
