On or about May 29, 1903, a borse and buggy, belonging to the appellant, was being driven north on Twenty-Fourth street in South Omaha, on the west side of the *768double tracks of tbe Omaha & Council Bluffs Street Railway Company, appellee. At a point between H and I streets there was a pile of lumber and a carpenter’s bench, at which one Ruffner was at work on or near the sidewalk.
