The plaintiffs, husband and wife, sue for damages for the death of their minor child, who, while at play, fell into and was drowned in a well or cistern, located on the boundary line between the residence properties owned by the respective defendants, but occupied at the time by their respective tenants. The two residence lots in question faced west on Lafayette Street, in Sedalia, Missouri, and were one hundred and twenty feet deep, extending to the Missouri Pacific Railroad right-of-way.
