Jess Baker was indicted for the offense of burglary. At his trial M. C. Baker, agent for the Southern Railway Company and for the Southern Express Company at Lindale, Georgia, testi*579fled that a room in the depot of the Southern Eailway Company, which was occupied and used by the Southern Express Company, was broken into and robbed on the night of October 31, 1913, and that four packages containing whisky, two of them weighing 50 pounds and valued at $10, and also a package of Woodruff’s rye whisky, worth $10, were missing, and not to be found on the morning of November 1; that an iron bar in…
