At the November term, 1899, of Douglas superior court, W. A. Taylor was tried and convicted of the *152offense of incestuous adultery alleged to have been committed Avith his stepdaughter, Maggie McGuire. The case is here for review upon assignments of error to divers rulings made at the trial. As we are constrained to reverse the judgment, we will deal with all the points made in the record which are of sufficient materiality to require special notice and which may probably arise on the next hearing.
