The appellee, the Cotton Mills Products Company, sued the appellant, the Georgia Casualty 'Company, in an action of trespass upon the case — an action in tort for negligence in failing and refusing to settle the claim of Oliver, an employee of the appellee, for an injury received in the course of his employment, against which accident to the employee the insurance company had issued to the employer its policy indemnifying it from loss in the limited amount stipulated therein.
