THIS MATTER is in the Appellate Division on Petition for Review from the Jury Trial Division. Clement Xavier appeals an order a Superior Court magistrate1 issued, granting a motion filed by Treasure Bay Virgin *255Islands Corporation (doing business as Divi Carina Bay Casino) (“Treasure Bay”) to compel arbitration and stay further proceedings.
