Spencer, J.:

Defendant appeals from conviction by a jury of possession of marijuana (K.S.A. 1976 Supp. 65-4127b[a][3]).

On May 6, 1976, Topeka police officers executed a search warrant for marijuana at 3316 DuPont in Topeka. When the officers arrived, they found the defendant in the process of backing a van out of the driveway. Defendant was stopped and he and the van were searched, but no contraband was found. The officers then proceeded to make a search of the dwelling, in which they found and seized two pipes which smelled strongly of marijuana, a screen, and an envelope from the Topeka…
