This action came into this court on a petition in error to the common pleas court of Cuyahoga county.

In that court plaintiff, by her father and next friend, brought an action against the defendant, Max Marmorstein, receiver of the Walther Apartments, to recover damages for an injury occasioned to her! in an elevator installed in said apartment building, and in the court below she recovered a judgment for some $12,000.
