This action arose from dealings between the parties wherein the plaintiff, a manufacturer of storage batteries, sought to secure from the defendant, a manufacturer of machinery, a pasting machine for use by plaintiff in one of its manufacturing processes. A machine was leased by defendant to plaintiff and installed in its plant, when plaintiff, after various tests, alleged that it was not fit for the special purpose for which it was purchased and offered to return the machine.
