— In an action to recover upon two policies of life insurance, the defendant moves for reargument of an appeal by the plaintiff from so much of an order of the Supreme Court, Queens County (Lerner, J.), dated November 24, 1983, as denied those branches of the plaintiff’s motion which were to dismiss the defendant’s first affirmative defense and for summary judgment. The appeal was decided by an order of this court dated April 15, 1985 (Angulo v Security Mut. Life Ins. Co., 110 AD2d 737).
