Appeal from a judgment of the County Court of Ulster County (Vogt, J.), rendered April 10, 1987, upon a verdict convicting defendant of two counts of the crime of criminal possession of a controlled substance in the third degree.

On May 22, 1986, members of the City of Kingston Police Department and the State Police arrived at apartment 31-A of the Waterside Apartments in Port Ewen, Town of Esopus, Ulster County, to execute a warrant for the arrest of Dudley Dixon, defendant’s half brother.
