Plaintiff-appellant Douglas Hoffer (“Hoffer”) brought suit under 42 U.S.C. § 1983 against defendants-appellees Janet Ancel, the Commissioner of the Vermont Department of Taxes (the “Department”), and Charles Merriman, an attorney for the Department who was assigned to handle Hoffer’s administrative appeal of his tax bill.
