From a nine-man verdict for $4,127.50 in favor of plaintiff and judgment thereon defendant prosecutes this appeal.

Plaintiff declared on “a certain written contract ... to sell, deliver and install linoleum to the defendant at an agreed price of Thirty-Three cents (330) per square foot” and prayed judgment for $4744 plus interest.
