MEMORANDUM DECISION AND ORDER
ROBINSON, District Judge.
I. INTRODUCTION:
On March 23, 2004, this Court conducted an evidentiary hearing (the “Hearing”) on the question of whether diversity jurisdiction exists in connection with this matter. At its core, this action is a breach of contract claim governed by New York state law. 1 More particularly, Kenneth W.
