This is an action to recover possession of certain land, and to restrain defendants from doing certain acts thereon in the nature of waste. Judgment went for plaintiff, and defendants appeal from the judgment, and from an order denying a motion for a new trial.
The land in contest is within the limits of the grant of lands by Congress to the California and Oregon Railroad Company, a corporation; and on March 17,1875, *237the government of the United States executed and delivered its patent, in due form of law, to the Central Pacific Railroad Company, a corporation, successor to said first-named…
