Appeal *1134from a judgment of the County Court of Warren County (Moynihan Jr., J.), rendered October 3, 1990, convicting defendant upon his plea of guilty of two counts of the crime of sodomy in the first degree.

In May 1989, defendant was arrested and charged with first degree sodomy based on the complaint of a seven-year-old boy. A second charge involving another minor was subsequently brought and defendant was eventually indicted on charges of two counts each of first degree sodomy and first degree sexual abuse (see, Penal Law § 130.50 [3]; § 130.65 [3]).
