delivered the following opinion:

This cause is before us on a motion for a new trial. It is a personal injury case. It has been tried before a jury three times within the last year and a half. In the first two trials the jury failed to agree; and in the latter they returned a verdict in favor of the plaintiff for $4,000. Under the organic act, no appeal lies from the action of this court when no con*411stitutional question or law of tbe United States is involved, unless the decision is for more than $5,000, exclusive of interest and costs.
