The plaintiff, Electronic Frontier Foundation (“EFF”), brings this action pursuant to the Freedom of Information Act (“FOIA”), 5 U.S.C § 552 (2006), against the United States Department of Justice (“DOJ”), seeking the release of agency records from the Federal Bureau of Investigation (“FBI”) concerning the FBI’s Investigative Data Warehouse (“Data Warehouse”). 1 Complaint (“Compl.”) ¶ 1.
