*307Timberlake, Currie & Company, Incorporated, brought action against the Chesapeake and Ohio Railway Company for damages to a carload of lettuce, caused by the alleged negligence of the defendant. The plaintiff recovered a judgment for $336, of which the defendant company now complains.

The parties will be referred to as plaintiff and defendant, with respect to their positions in the trial court.

The lettuce which was shipped in refrigerator ear P. F. E. 11633 on April 10, 1923, from El Centro, California, over the Southern Pacific and C. R. I. & P. (Rock Island) railroad, was consigned to…
