WICKER, District Judge.

This matter is before the court on motion of defendants Bob A. Hardesty, Raymond A. Lapino, and Myron E. Moorehead (“Har-desty, et al”) to dismiss for failure to state a claim upon which relief could be granted and/or for summary judgment. Having reviewed the record, the memoranda and exhibits of counsel, and the applicable law, IT IS ORDERED that the motion of Har-desty, et al to dismiss IS GRANTED.
