Plaintiffs Lilliana Marrero and Eliud Falcon, former employees of defendant Modern Maintenance Building Services, Inc. (“Modern”) and members of defendant Service Employees International Union, Local 1 (“SEIU”), bring this hybrid § 301/ fair representation action against Modern, SEIU and a former SEIU employee, Burke Wortmann.
