DECISION AND ORDER

This matter comes before the Court on the motion of Plaintiff Tanya Creations, Inc.(“Plaintiff’) for summary judgment. However, in reality it is a motion for partial summary judgment on the issue of liability. Plaintiff seeks a determination that Defendants The Talbots, Inc. (“Tal-bots”), Erwin Pearl, Inc. (“EPI”), and F.O., Inc.
