This is an appeal on questions of law from a judgment of the Common Pleas Court of Montgomery County entered on a verdict rendered in favor of the plaintiff. The action is for wrongful death arising out of an automobile accident which occurred on U.S. highway No. 25 near the boundary line between Warren and Butler counties.
