This appeal involves the relationship between an action brought in the state courts of New Mexico by Deborah Berardinelli, whom we shall call the plaintiff, against General American Life Insurance Company, and an earlier settlement of a class action against General American in the United States District Court for the Eastern District of Missouri. 1 The plaintiff was a member of the class in the earlier case, received notice of the settlement, and did not exercise her opportunity to opt out.
