MEMORANDUM OF DECISION AND ORDER
SPATT, District Judge.
This case arises from the plaintiffs allegations that she was passed over for a promotion to the rank of lieutenant in the Nassau County Sheriffs Department in violation of 42 U.S.C. § 1983, Title VII of the Civil Rights Act of 1964, and the New York Executive Law § 290, et seq.
