On August 22, 1917, the plaintiff filed an affidavit for the replevin of a Ford automobile. The affidavit among other things set up that the defendant wrongfully took and wrongfully detained said automobile from the plaintiff. On the same date a “fourth-class replevin writ” was issued, and on the 24th day of the same month that writ was returned and recited that a demand had been made and that it was “unexecuted as to the within described property.” On September-1, 1917, the defendant entered its appearance, and, on the 17th day of the same month, the court entered an order granting leave to…
