INTRODUCTION

The Plaintiff, Raytheon Engineers and Constructors, Inc. (“Raytheon”), brings this action against Erie Interstate Contractors, Inc. (“Erie”), TIG Insurance Company (“TIG”), and General Star National Insurance Company (“General Star”). In May 2006, a multimillion dollar judgment entered against Raytheon in a personal injury action brought by David Hathaway (“Hathaway”) and others.
