LATIMER, Justice.

Review of an order of defendant Commission denying plaintiff’s application for a permit to operate as a contract motor carrier for a designated company over highways of this state.

The fact are relatively simple and, for the most part, not in dispute. On January 1, 1940, plaintiff was hauling (without permit or authorization from the 'Commission) certain personal property consisting generally of track materials, machinery, wire, lumber, furniture, scrap iron, cement, and lumber.
