This is an indictment under section 4246, E. L., which provides that persons, between whom marriages are prohibited by sections 2306-7, R. L., who intermarry, or *617who commit fornication with each other, shall be punished as in case of adultery. The indictment is in two counts, each of which charges that the respondent, Foster S.
