This action was brought by the United States against Benjamin B. Emory and his sureties, upon his official bond, as collector of internal revenue for the Third District of Mississippi. The bond, dated March 29, 1870, is in the penal sum of $50,000, and reciting that' he had been appointed and had received a commission' as such collector, dated Dec. 29, 1869, is conditioned that “ he shall truly and faithfully execute and discharge all the duties of the said office according- to law, and shall justly and- faithfully account for and pay over to the United States, in compliance with the orders…
