I. INTRODUCTION

Plaintiff James Deferio (“Plaintiff’) commenced this action against the City of Syracuse and three of its police department personnel1 (collectively, “Defendants”) under 42 U.S.C. § 1983, alleging violations of his First Amendment right to demonstrate at the annual Central New York Pride Week (“CNY Pride”) in Syracuse, New York.
